Telecommunication activities of operators is subject to rules of globalization and is susceptible to the economy of scale to the same extent as mass manufacturing or mass ICT service provision. The profitability of investments in new electronic telecommunications technologies clearly depends on their scale. Meanwhile, European telecom operators are frequently restrained to small markets.

The development of legal frameworks should take into consideration economic conditions of the functioning of 5G network and Industry 4.0 enterprises. The European legal framework should allow for merging or convergence of telecommunications services, as well as takeovers and mergers on the scale in which it takes place in large Asian markets and in the USA.

New technologies change the society’s way of life, but also consequently make it necessary for telecommunications entrepreneurs to adapt to the new requirements of customers on various European and global markets. The industry expects to provide IIoT services in networks of ensured quality throughout EU and even globally. Without reforming EU competition law, telecommunications companies will not be able to meet customer needs and face the global competition.

The discussion relate to problems related to cooperation and consolidation. We will take on defining the reasons of prolonged negotiation with the antitrust office, which led to, for example, the unprofitability of consolidation transactions. It is also necessary to analyze legal changes that will allow companies to cooperate more closely without being exposed to accusations of monopolistic practices, price fixing, etc.

Andrzej Abramczuk posiada blisko 20-letnie doświadczenie w doradztwie na rzecz podmiotów z sektora telekomunikacyjnego oraz mediów. W ciągu ostatnich kilkunastu lat wspierał największe transakcje w branży mediów i telekomunikacji na polskim rynku.

Od września 2009 roku związany z kancelarią Chajec, Don-Siemion & Żyto, gdzie od stycznia 2011 jest Partnerem odpowiadający za praktykę TMT. W latach 2001 – 2006 był dyrektorem departamentu prawnego oraz członkiem zarządu GTS Poland i Cel Polska. W latach 2006 – 2009 związany był ze spółką P4 (operator sieci Play).

W latach 2011 – 2015 zasiadał w Radzie Nadzorczej CenterNet S.A. i był sekretarzem RN spółki Midas S.A. (obecnie Aero2 Sp. z o.o.). Jest też aktywnym uczestnikiem życia organizacji branżowych, m.in. wiceprzewodniczącym Rady PIIT oraz członkiem Rady KIGEiT.

Andrzej Abramczuk ukończył Wydział Prawa i Administracji Uniwersytetu Warszawskiego oraz studia podyplomowe, prowadzone przez Wyższą Szkołę Ubezpieczeń i Bankowości wraz z City University Business School of London oraz studiów doktoranckich w Instytucie Nauk Prawnych PAN.

Jean-Marc Harion has been a member of the Management Board of P4 sp. z o.o. („Play”) since July 2018. He also performs the function of Chief Executive Officer and the president of the Management Board. Prior joining the Group Play, Jean-Marc Harion had over 25 years of experience within the telecommunications sector, most recently serving as CEO of Orange Egypt and Mobistar, both listed companies, and previously as CEO of Orange Dominicana and Orange VP Business Development Americas in New York. Prior to joining Orange Group, Jean-Marc Harion established his own company, Computer Channel, which he developed over a 10 year period before it was sold to Wanadoo (France Telecom Group). Mr. Harion holds a master’s degree from the Institut d’Etudes Politiques de Paris and a master and post-graduate degree from the Université Libre de Bruxelles.

Nikodem Bończa Tomaszewski

IT manager with broad experience in managing digital organisations. He was the co-founder and the first director of the National Digital Archives (NAC) in the years 2008-2012. After that, for four years he was the director of Center for Informatics Technology (COI), which he then transformed into a center of digital literacy for the state. Under his leadership, both the System of National Registers and a well-protected server base – Integrated Registers Infrastructure, were created at COI. His managerial activities in the IT field are directed towards ensuring the country sovereignty in a digital sphere, and additionally the construction of the common well-being by means of IT tools. He formulated the idea of „service state”. Under his leadership, lots of facilities for citizens were created such as portals, providing several million digitised documents and archival photographs, as well as various e-services platforms: obywatel.gov.pl, historiapojazdu.gov.pl and also bezpiecznyautobus.gov.pl. He has been recently awarded the prestigious title of „Chief Information Officer of the Year 2015” by the Polish IT managers’ industry.
